In a milestone, Pa. tightens gun control in domestic abuse cases

Filed under: Gun Control — tmaster @ 5:23 pm

Under the new law which takes effect in May, those accused of domestic violence under protection-from-abuse orders can be forced to give up all of their guns.
In Pennsylvania, more than 40,000 protection-from-abuse orders were filed in 2003, according to the most current statistics available.
Pennsylvania’s law is unique in that it creates an accountability system for third parties who hold onto a defendant’s weapons for safekeeping while the restraining order is in effect, said Amy Sousa, policy specialist for the state coalition.

The law also allows courts to order accusers who seek protective orders based on groundless allegations to pay damages and attorneys’ fees to defendants - an important concession to gun owners’ groups, said Lowell Graybill, past president of the Pennsylvania Federation of Sportsmen’s Clubs.

Strange thing about this law is that it has a provision to return the guns after the restraining order expires but federal law doesn’t allow the guns to be returned after you are convicted. Law apears to remove guns from people who are not even convicted.
